Disclaimer

(THERE ARE OTHER DISCLAIMERS IN OUR TERMS OF SERVICE AND POLICIES)

By purchasing, ordering from, or otherwise using our website, you indicate your knowledge and agreement to our terms.

Unless otherwise stated, all products sold by House of ELA Design LLC are fashion (costume) jewellery (hereafter jewellery).  Each piece is handmade: of a greater perceived value than assembly line or machine made (sturdier) items.  Our pieces are made of a wider range of materials, including precious and semiprecious metals, stones and gemstones.  Our pieces, however, do not include said metals, stones or gemstones, unless otherwise specified.

House of ELA Design LLC does not carry out gemological, chemical or other tests on materials provided by suppliers and acts in good faith in adopting for use supplier product descriptions and other information. House of ELA Design LLC relies on supplier information in good faith, and disclaims any and all responsibility for errors or inaccuracies in supplier and other third party information.  House of ELA Design LLC offers no guarantee or warranties about the nature, quality, quantity, fitness, composition, or utility of its jewellery to the extent permitted by law.

Our jewelry may contain elements of base metal, brass, copper, nickel, gold, silver or other alloys.  They may contain lead components and are therefore not intended for children.  It is the responsibility of the customer – and not House of ELA Design LLC – to be aware of their allergies, and to decide – without or regardless of any reliance upon the express or implied statements, descriptions, presentations or representations of House of ELA Design LLC - about whether to purchase a piece (or not).

Although extremely rare, some people are allergic to the metals and finishes commonly used in making jewelry. It is the responsibility of the consumer to be aware of any allergies he or she may have to metals or the oxidation applied to metals prior to making a purchase. House of ELA Design LLC does not know the medical history of our customers.  House of ELA Design LLC offers no guarantee against allergic reactions. House of ELA Design LLC will not be held liable for any allergic reactions that may occur as a result of wearing our jewelry.  If you are allergic to metals or metallic alloys, your purchase of our jewellery is at your own risk.

Our metallic jewellery designs are crafted from stainless steel or sterling silver unless otherwise specified.  While efforts are made to source jewellery findings in stainless steel or sterling silver, our jewellery findings – including pendants, tokens (charms), clasps, jump rings, crimp beads and tubes, ornamental or mini chains, spacers etc may contain or be made of base metal, brass, copper, nickel or other alloys.  While the oxidation (tarnishing) of such pieces over time is an inevitable process factored into the design of our pieces for a deliberate ‘antique’ or ‘vintage’ effect, careful care, including avoiding contact with water or other liquids, will prolong the life and appearance of your jewellery.

House of ELA Design LLC may not be held liable nor responsible for any harm or accidental damage experienced by persons or property in connection with the wearing or use of our jewellery pieces and/or components.

House of ELA Design LLC is not responsible for the effects of wear and tear (normal and extraordinary), improper care or other diminutions after purchase.  Our recommended care instructions include:

- Wear your jewellery only after applying makeup, perfume, and hair products.
- No contact with bleaches and detergents wherever possible
- Keep your jewellery safely out of reach of children and animals.
- Always remove your jewellery when engaging in activities that risk impact or exposure to chemicals, heat or water such as sports, housework or cooking.
- Store your jewellery in the original packaging or in a soft pouch to avoid scratches.
- Do not swim or bathe while wearing your jewellery
- Do not keep your jewellery in direct sunlight: prolonged exposure to sunlight can cause your jewellery to fade and lose its color

Note that ‘Defects’ do not include chipped, cracked or broken gemstones or inclusions, nor worn plating or the wearing off of an 'oxidized' or ‘antique’ finish.  General wear and tear - for which House of ELA Design LLC takes no responsibility - includes oxidation (tarnishing) and the distortion or warping of pieces misshapen by harsh or careless handling.

The words used to describe each piece of jewellery reflect the look, feel, and/or function of the piece, and are not a promise nor intended to be a legally binding undertaking.  House of ELA Design LLC cannot guarantee that the colours illustrating the products will be rendered correctly on different computer monitors. Any product dimensions provided also are for the purposes of approximate guidance only and are intended to give only approximate indications of size. There may be slight variations in size, shape or colour in the the products displayed on our website that are not a product flaw, but a natural design characteristic that is not within our control.

Every effort is made to ensure you are given sufficient information to be satisfied with your jewellery. We will gladly maintain our pieces should anything happen under normal use.  If your jewellery is faulty or broken on arrival (after mailing), House of ELA Design LLC will repair or replace it subject to assessment and our determination of the cause of damage.  House of ELA Design LLC’s determination of the cause of damage is final and not subject to appeal.

Avoid wearing jewellery when operating machinery.  Also note that magnetic items and findings should be worn with care by those with pacemakers and other implants, as magnetic metals may interfere with the correct functioning of such medical devices.
